Exemption from liability
1. Content of online offer
The author shall not bear responsibility for timeliness, accuracy, completeness or quality of information provided. Liability claims on the author relating to material or intangible damage caused by use or non-use of information or use of erroneous or incomplete information shall be ruled out as a matter of principle unless evidence is provided to the author’s premeditated failure or gross negligence.
All offers or proposals may be subject to change without notice and are not of binding nature. The author reserves the explicit right to change, enlarge or delete the entire offer or parts of it or to discontinue its publication temporarily or for good.
2. References and links
For direct or indirect references to third parties’ websites (hyperlinks) which are beyond the author’s responsibility duty of liability would apply only to cases in which the author had been aware of the content and had been technically capable of preventing use of such illegal content or in which such preventive attempt was acceptable for him.
The author hereby declares that at the time of linking no unlawful content had been discernible on the pages linked. The author has no influence on the current or future layout, content or authorship of linked/attached pages. The author, consequently dissociates explicitly from any content of any linked page that had been changed after initial linking. This declaration shall apply to all links and references within the author’s internet presentation as well as to entries made by third parties to visitor books, discussion platforms, link lists, mailing lists and other types of databases to which external access is possible. For illegal, incorrect or incomplete content and especially for damage due to use or non-use of such information, liability shall be limited to the author of the referred page rather than to the person who has made reference to that page via a link.
3. Copyright and labelling provisions
The author undertakes to take into due consideration for all publications the copyright of graphs, sound documents, video sequences and texts as well as to use his own graphs, sound documents, video sequences and texts or to resort to graphs, sound documents, video sequences and texts for which no licence fee has to be paid. All trade marks or brand names mentioned in an internet presentation and protected by third parties are subject to the labelling provisions valid at the time of presentation as well as to all property rights of the registered owner. Verbal reference to a trade mark or brand name does not automatically mean that they are not protected by rights of third parties.
The copyright for published items designed by the author shall be retained exclusively by the latter. Such graphs, sound documents, video sequences and texts shall not be used or reproduced in other electronic or printed publications without the author’s explicit consent.
4. Data protection
Entry of personal or commercial data into an internet presentation (e-mail address, name, postal address) shall be considered the user’s absolutely voluntary act of disclosure. Use of and payment for all services advertised is permissible without disclosure of such data or by using anonymised data or pen names, if such approach is technically feasible and acceptable. The use by third parties of contact data published in the imprint or otherwise (postal address, phone, fax, e-mail etc.) to send not explicitly requested information shall be impermissible. Legal action is explicitly reserved to deal with spam-sending offenders.
This exemption from liability is an integral component of the internet presentation from which reference is made to this page. If any part or formulation of this text be partially or completely held to be invalid or in disagreement with current law, it shall no longer apply, and the remaining parts or formulations shall remain in full force and effect.
